1. Acceptance

By using magentadrugtest.com (the "Site") or buying any product, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old to create an account or place an order. You agree that all information you provide is accurate and that you have authority to make purchases on behalf of any organization you represent (for wholesale / B2B accounts).

3. Account responsibilities

Keep your password confidential. You are responsible for all activity under your account.
Notify us immediately of unauthorized access at security@magentadrugtest.com.
We may suspend or terminate accounts used for fraud, abuse, harassment, scraping, or any unlawful purpose.

4. Acceptable use

You agree not to:

Use the Site to commit fraud or violate any law.
Resell our products in a way that misrepresents their FDA clearance status or intended use.
Scrape, crawl, or systematically extract data from the Site.
Reverse engineer or attempt to bypass any technical protection measure.
Upload malicious code, harass other users, or interfere with the operation of the Site.

5. Product information & disclaimers

Read this section carefully — it is the most important part of these Terms.

Screening only

All Magenta drug-testing kits sold for medical or workplace use are FDA-cleared screening devices. Screening tests provide presumptive results only. Any positive screen that will be used to make a medical, employment, legal, custody, or disciplinary decision MUST be confirmed by a SAMHSA-certified laboratory using a gas chromatography / mass spectrometry (GC/MS) or LC-MS/MS confirmatory method.

17-panel cup — forensic use only

Our 17-panel cup is sold for FORENSIC USE ONLY. It is not FDA-cleared and must not be used for any medical purpose or to make any medical or employment decision. Buyers of the 17-panel cup represent that they are using it solely for forensic, research, or training purposes.

No interpretation services

We provide products. We do not interpret results, render medical opinions, or provide legal or HR advice. Misinterpretation of a result is the responsibility of the buyer or their qualified medical professional.

Storage & expiration

All test kits have an expiration date printed on the package. Tests stored outside the temperature range printed on the package, or used after their expiration date, may produce inaccurate results. Magenta is not responsible for results from improperly stored or expired tests.

At-home DNA tests — peace of mind only

Read this before ordering any DNA test.

Our at-home DNA tests are sold for peace of mind and personal information only. They are NOT legal, court-admissible, or chain-of-custody tests, and they are not to be used to make any legal, custody, child-support, immigration, employment, or medical decision. For any legal purpose you must use a court-approved, chain-of-custody DNA test performed through an accredited laboratory where a neutral third party verifies each participant's identity.

By ordering a DNA test you represent and warrant that:

You are 18 or older and are ordering for a lawful, personal, informational purpose only.
You have the legal right and authority to submit each sample. You have obtained the informed consent of every adult participant, and you are the parent or legal guardian of, or otherwise legally authorized to test, any minor whose sample you submit.
You will not submit any person's DNA sample without their knowledge and consent where consent is required by law.
You understand results are informational only and you will not rely on them for any legal or medical decision.

You are solely responsible for how you collect samples and how you use your results. To the fullest extent permitted by law, Magenta is not liable for any misuse of a DNA test, for samples collected without required consent, or for any decision made in reliance on an informational result.

Sample & data handling. Samples are used only to perform the test you ordered and are handled by our partner laboratory. Results are delivered privately and are never sold. See our Privacy Policy for how we handle DNA-related data.

DNA add-ons. Certain DNA products are add-ons — for example, an Additional Tested Party or Unusual Sample Processing tier. Add-ons are modifiers for a base DNA test and are not standalone tests. You must order an add-on together with a base DNA test in the same order; an order consisting only of add-ons cannot be placed or processed. For unusual-sample add-ons, the laboratory assesses each sample on receipt and assigns the appropriate processing tier; if your sample requires a different tier than the one purchased, we will contact you before proceeding, and any difference may be billed or refunded accordingly. Recovery of usable DNA from non-standard samples is never guaranteed.

6. Pricing, taxes, and shipping

All prices are in US dollars and are subject to change without notice.
We charge sales tax based on your shipping address where required by law.

We currently ship to addresses in the United States only.

7. Wholesale / B2B accounts

Wholesale pricing and NET 30 payment terms are available only to approved business accounts. Approval is at our discretion. NET 30 credit may be revoked at any time for late payment. Invoices unpaid after 60 days may be referred for collection and you agree to pay reasonable collection costs and attorneys' fees.

8. Returns & refunds

See our Refund Policy. Returns must be initiated through your account portal within 30 days of delivery.

9. Intellectual property

The Magenta name, logo, product images, and the contents of the Site are owned by Magenta Drug Test and protected by US and international intellectual property laws. You may not copy, modify, or distribute any of it without our written permission, except as needed to view it in your browser.

Any product review or feedback you submit grants Magenta a worldwide, royalty-free license to display, edit (for length and clarity), and reuse that content on the Site and in marketing.

10. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT AS REQUIRED BY LAW. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGENTA'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS, OR DAMAGES FROM MISINTERPRETATION OF SCREENING RESULTS.

Some states do not allow the exclusion of certain warranties or the limitation of incidental or consequential damages, so the above may not apply to you in full.

12. Indemnification

You agree to indemnify and hold Magenta harmless from any claim arising from your misuse of any product, including but not limited to using a screening test as a basis for medical, legal, employment, or disciplinary decisions without confirmatory testing.

13. Governing law & disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in [county], New Jersey, and you consent to that jurisdiction.

Counsel review note: an arbitration / class-action waiver clause is not included here. Add only if counsel advises.

14. Termination

We may suspend or terminate your access to the Site at any time, for any reason, including violation of these Terms. Sections 5, 9, 10, 11, 12, and 13 survive any termination.

15. Changes

We may update these Terms by posting a new version with a new "Last updated" date. Continued use of the Site after a change constitutes acceptance.
